The Public Prosecutor filed a lawsuit asking the Justice Department that the City of São Paulo paralyze all works of bike paths in the city, including that of Avenida Paulista. The lawsuit was filed by the prosecutor Camila Mansour Magalhães da Silveira, who considers that the management Fernando Haddad (PT) did not make the necessary planning for the implementation of the cycle network.
The prosecutor accuses Haddad of creating bicycle lanes “without proper evaluation of traffic effects,” citing also the safety of cyclists and pedestrians as a motive.
Public prosecutors concluded that “the reports submitted by the CET and the City Hall are of the type press releases of the established bicycle lanes, published on the CET website for consultation with the general population, not being part of this Engineering, ie design or feasibility study, basic design and executive design”.
In the action, are also attached several photos of bike paths with faded paint and stretches over the sidewalk. The Public Prosecutor’s Office asks for an injunction with a daily fine of R $ 100,000 if the city does not stop the construction of bicycle lanes until a technical feasibility study, basic project, executive project, and public hearings on “whole and Any cycle path, cycle path and cyclorotate”.
The lawsuit also asks justice that the city hall be forced to restore the paving of the central areas, sidewalks and roads where services have not been completed, as in the case of Avenida Paulista. The daily fine in case of noncompliance would also be R $ 100 thousand and the deadline given is 30 days.
The court has not yet ruled. The report contacted the city hall, which has not manifested itself to date.
